Discrimination Claims negotiates $50,000 for apprentice after dick pic prank

Discrimination Claims has negotiated $50,000 compensation for a 15 year-old apprentice, after he was subjected to a dick pic prank.

The young man’s boss took a number of photos of his own penis using the worker’s phone.

Discrimination Claims filed multiple claims in the Queensland Human Rights Commission against the employer, including:

  • sexual harassment,
  • sex discrimination, and
  • race discrimination.

The details

The young man worked for the food retail business for a short time when his boss took his phone without his knowledge.

The boss used the phone to take pictures of his own penis.

Some of the images show the older man exposing his penis with a smiley face drawn on it with a black pen.

The boy discovered the appalling images later when he was checking his phone.

He never went back to work.

Worker distraught

“The young man and his mother are both distraught that this sort of thing happened,” Miles Heffernan from Discrimination Claims said.

“This creep thought it was funny to take pictures of his penis using the boy’s phone without giving any consideration as to how it might affect him.

“It was a very, very dumb thing to do – and could possibly amount to criminal conduct.

“And stupidly, he literally handed over the evidence of his wrongdoing taking the images using the boy’s phone.”

Matter settled during conciliation

Discrimination Claims immediately filed multiple claims on behalf of the boy in the Queensland Human Rights Commission.

During a recent conciliation session, the employer agreed to pay the boy $50,000 compensation for shock and distress.

“Sexual harassment is not a joke, and it’s not funny,” Mr Heffernan said.

“If you are going to behave inappropriately in the workplace, it will likely result in you paying tens of thousands of dollars in compensation.”
